By downloading, accessing, or using the Clubz mobile application ("Clubz"), you agree to abide by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Clubz and govern your use of the mobile application and associated services. If you do not agree to these Terms, you must not access or use Clubz.
1. Purpose of the App
Clubz is a digital platform designed to help individuals and groups organize, track, and manage friendly in-person card games and similar recreational activities. The app provides features for recording participation, tracking scores, monitoring group statistics, and maintaining historical records of gameplay. Clubz does not facilitate or process any form of real-money gambling or financial wagering and is not intended for commercial or professional gambling operations.
2. Eligibility and Age Restrictions
You may use Clubz only if you are of legal age to participate in recreational card games in your jurisdiction. The app is not designed for individuals under 18 years of age unless local laws permit otherwise for non-gambling recreational card play. You are responsible for ensuring that your use of Clubz complies with all applicable local, state, national, and international laws.
3. User Responsibilities
You agree to:
Provide accurate and current account information, including phone verification when required.
Maintain the confidentiality of your account credentials and restrict access to your device.
Be fully responsible for all activity that occurs under your account.
Use Clubz only for lawful purposes and in accordance with these Terms.
You further agree not to:
Use Clubz for any illegal activity or purpose, including commercial gambling or wagering with real currency.
Post, upload, or distribute any content that violates the rights of others or applicable laws.
Attempt to interfere with or disrupt the integrity or performance of the app.
4. Financial Data and Transactions
Clubz does not process payments, hold funds, or facilitate real-money transactions of any kind. Any references within the app to monetary amounts are for private group tracking purposes only. Users must not rely on Clubz as a payment processing service or financial intermediary.
5. Intellectual Property Rights
All intellectual property rights in the Clubz app, including but not limited to trademarks, logos, content, and software, are owned by Clubz or its licensors. You are granted a limited, non-transferable, non-exclusive license to use the app for personal, non-commercial purposes. Any unauthorized use, reproduction, or distribution of Clubz content is strictly prohibited.
6. Disclaimer of Warranties
The Clubz app and all related services are provided “as is” and “as available” without warranties of any kind, either express or implied. Clubz disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will operate uninterrupted, error-free, or free of viruses or other harmful components.
7. Limitation of Liability
To the maximum extent permitted by law, Clubz and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising from or related to your use of Clubz. Your sole and exclusive remedy for dissatisfaction with the app is to stop using it.
8. Termination and Suspension
We reserve the right, in our sole discretion, to terminate or suspend your access to Clubz, with or without notice, for conduct that we believe violates these Terms, applicable law, or is harmful to the interests of Clubz, other users, or third parties.
9. Modifications to Terms
Clubz may modify these Terms at any time. Any changes will be effective upon posting the updated Terms in the app. Your continued use of the app after such changes constitutes your acceptance of the revised Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Clubz is registered, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in such jurisdiction.
